Criminal justice is a series of judicial processes that deal with crimes that haveoccurred. Military criminal law can also be seen as a judicial function that handles crimes
occurring in the military, which exists to preserve combat power in peacetime and win
wars in wartime. The military criminal law, based on this military organization, consists of
strong and strict laws based on a crime control model that pursues the suppression and
reduction of crime as the top priority. Those subject to the Military Criminal Act, which
has these characteristics, are young people who are fulfilling their constitutional duty of
defense. They are dedicating their important years in their 20s to the defense of the
country by sacrificing their lives. For example, counseling before the start of a military
investigation, reconciliation mediation after the start of a military investigation, military
crime family council, military minor crime review committee, and sentencing meeting
before the military prosecutor decides. These are systems imbued with the ideology of
restorative justice, which are not currently seen in Korea's military criminal justice
system. If they can be realized through a review of whether to introduce them, they
could bring about great changes in the military criminal justice system of Korea.
