초록

The purpose of this study is to re-establish Korea’s security criminal law system according to the revision of the National Intelligence Service Law and the possibility of repealing the current National Security Law. Accordingly, by clearly understanding the background of changes in the security criminal law system in Korea and recognizing the need for changes in the security criminal law, the system of the security criminal law in Korea was examined, and problems caused by the conversion of the National Intelligence Service to a pure intelligence agency and the possibility of abolition of the National Security Law were examined. It is necessary to recognize the need for a change in the security criminal law system. Therefore, under the assumption that the investigation authority and the National Security Law will be abolished according to the revision of the National Intelligence Service Law, the background and necessity of the change in the security criminal law system will be examined, and the national security criminal law, the Criminal Law, the National Security Law, the Anti-Terrorism Law, etc. will be compared and related foreign laws. The purpose of this study is to examine how a new security criminal law system unique to Korea should be established when the National Security Law is repealed through consideration.
